Creator License Framework

1. Overview

Kartoonii is a creator-first platform. References to "the platform" in this Framework mean the Kartoonii Service (website, applications, and services) as defined in the Terms of Use.

  • Creators own the assets and Works they create.
  • Players can interact with those assets within the permissions defined by the creator.
  • Kartoonii provides the tools, storage, and platform for creation, sharing, and interaction.

This framework defines:

  • Ownership
  • Permissions
  • How assets and Works can be used, shared, and extended

2. Key Definitions

Creator — A user who creates assets, scenes, or tools within Kartoonii.

Player — A user who interacts with assets to create Works (e.g., swapping parts, changing colors, or creating scenes).

Asset — A creator-made resource used within Kartoonii. Assets may include:

  • Modular assets (templates, characters, parts)
  • Flipbooks (animated sequences)
  • Color palettes
  • Brushes and effects

Different asset types may have different usage and licensing rules.

Tool Asset — An asset used to create or modify artwork (e.g., brushes, effects, palettes).

Content Asset — An asset used within compositions or scenes (e.g., characters, templates, props).

Scene — A composition created using one or more assets.

Work — A user-created composition or configuration of one or more assets. A Work may exist within Kartoonii or be exported (e.g., a styled character, scene, or flipbook).

3. Ownership

3.1 Creator Ownership

Creators retain full ownership of the assets and Works they create.

3.2 Player Ownership

Players own the Works they create.

However:

  • Works may include assets created by others.
  • Use of those assets is governed by the creator's license.

Players do not own the underlying assets themselves.

3.3 License Persistence for Existing Works

License permissions that applied at the time a Work was created will continue to apply to that Work, even if:

  • the creator later changes the asset's permissions,
  • the asset is removed from the platform, or
  • the creator's account is suspended or terminated.

This persistence applies only to the specific Work as created and does not grant rights to reuse the underlying asset outside of that Work.

3.4 Kartoonii Rights

Processing for Functionality

Kartoonii processes content to provide core functionality (e.g., rendering, previews, thumbnails, and editing). This processing may occur locally on your device or on Kartoonii's servers.

This processing is limited to what is necessary to operate the product and does not grant Kartoonii any ownership of your assets or Works.

Storage and Sharing

Content in Kartoonii may be stored locally, synced to the cloud, or shared with others.

When content is stored on Kartoonii's servers or shared with other users, you grant Kartoonii a non-exclusive, worldwide license to:

  • Store and host your content
  • Reproduce your content as needed for operation
  • Display your content within the platform
  • Distribute your content as part of sharing features (e.g., links, invites, gallery)
  • Promote your content within Kartoonii (e.g., featured sections or discovery surfaces)

This license is granted solely for the purpose of operating, improving, and promoting the Kartoonii platform.

Kartoonii does not claim ownership of your assets or Works.

Nothing in this Framework grants rights to access, extract, or reuse underlying asset files outside of the functionality provided by Kartoonii.

4. Creator Permission Model

Each asset has a permission setting defined by the creator.

4.1 Personal Use (Default)

Players may:

  • Use assets to create Works
  • Export Works
  • Use exported Works for personal, non-commercial purposes

This includes freely exploring and experimenting with assets to create different Works.

Personal use includes non-commercial uses such as creating physical items (e.g., prints, stickers, or merchandise) for personal enjoyment or as gifts, provided no sale or commercial distribution occurs.

Some features, including saving Works within Kartoonii and access to certain export formats (e.g., vector formats), may require a paid subscription.

Players may not:

  • Sell or license Works
  • Use Works in commercial contexts, including for marketing, branding, or monetized content
  • Use Works in monetized platforms (e.g., ad-supported or subscription-based content)

4.2 Commercial Use Allowed (Optional)

Commercial use of Works is permitted only when:

  • The creator of the asset has enabled commercial use
  • The player has access to commercial use features (which may require a paid subscription or other eligibility criteria defined by Kartoonii)

When permitted, players may:

  • Use Works in monetized content (e.g., videos, streaming, social media, or branding)
  • Use Works in commercial projects

Restrictions:

  • Assets themselves may not be resold, redistributed, or offered as standalone content
  • Works may not be used in a way that enables extraction or reuse of underlying assets

4.3 Asset Reuse

Assets are provided for use in creating Works within Kartoonii.

Players may use assets to create Works (e.g., scenes, compositions, or exported images).

Players may not:

  • Use assets to create new reusable assets, templates, or components within Kartoonii
  • Extract, reproduce, reverse-engineer, or recreate assets for the purpose of:
    • building new reusable assets, templates, or components
    • use in other asset-based or template-based systems
    • distribution as standalone or reusable content
  • Use exported Works, or any portion of assets, to reconstruct or replicate substantially similar assets for reuse or redistribution

4.4 Attribution (Optional)

Creators may require attribution for use of their assets.

When attribution is required:

  • Players must provide appropriate credit to the creator when sharing or publishing Works publicly
  • Attribution must not be removed, obscured, or misrepresented in a way that hides the creator's identity
  • Players may not claim creator assets as their own original work

Where attribution is required by a creator, Kartoonii will indicate this clearly within the asset's metadata or licensing information. Users are responsible for complying with displayed attribution requirements when sharing Works.

Kartoonii may include creator attribution (e.g., signatures or metadata) in exported Works, but removing such attribution does not remove the obligation to credit the creator.

4.5 Color Palettes

Color palettes are treated differently from other assets.

Creators may:

  • Export color palettes
  • Use color palettes outside of Kartoonii
  • Share or sell color palettes independently

Players may import color palettes for use within Kartoonii. Players are responsible for ensuring they have the necessary rights to import and use color palettes.

Imported palettes must be used in accordance with applicable rights and permissions.

Color palettes are not subject to the asset reuse restrictions in Section 4.3.

Color palettes do not include graphical elements, shapes, or other visual assets.

5. Use of Works

5.1 Allowed

Players may use Works outside of Kartoonii, including:

  • Sharing Works (e.g., social media, messaging, or personal websites)
  • Using Works as profile images or avatars
  • Including Works in personal or creative projects

Such use must comply with the permissions defined in Section 4, including any restrictions on commercial or monetized use.

5.2 Restricted

Players may not:

  • Sell or license Works except where commercial use is permitted under Section 4
  • Use Works in a way that enables extraction, reuse, or redistribution of underlying assets
  • Use Works to create or distribute competing asset libraries or template systems
  • Misrepresent the origin of Works or imply authorship of assets they did not create

6. Sharing & Access

Creators may share assets and Works using features provided by the platform, including direct links, invitations, and other sharing mechanisms made available by Kartoonii.

Access grants:

  • Permission to interact with the asset
  • Does not transfer ownership

7. Platform Role

Kartoonii:

  • Enables creation, interaction, and sharing
  • Does not mediate ownership disputes between users
  • May review, restrict, or remove shared content that violates policies or may harm the platform or its users
  • Reserves the right to remove or limit access to shared content at its discretion

Users who believe their intellectual property has been infringed may submit a notice in accordance with the DMCA Policy described in the Terms of Use.

7.1 Effect of Account Termination

If a creator's account is terminated or content is removed:

  • Existing Works created in compliance with the applicable license at the time of creation may continue to be used in accordance with that license.
  • The affected assets will no longer be available for new Works unless otherwise restored by Kartoonii.

Kartoonii may remove or restrict access to content where required for legal or policy reasons.

8. Future Marketplace

This framework will expand to include:

  • Asset sales
  • Revenue sharing
  • Extended commercial licensing

9. Updates to this Framework

Kartoonii may update this Creator License Framework from time to time. Updates will apply prospectively and will not retroactively alter the license terms that applied to Works already created, except where required by law.

10. Guiding Principles

  • Creators own their work
  • Players can meaningfully interact with that work
  • Works can be used in real-world contexts
  • Assets themselves are protected from extraction and resale
